Faults show Lake Tahoe area's shaky past

As a cross-country skier trekked through the wilderness near Lake Tahoe 15 years ago, he noticed something odd about the trail he'd taken. The hill crest that had been beneath his skis abruptly dropped off, then picked up again about 20 feet away.

As luck would have it, the skier was a geologist, and the oddities of that trail ? including the offset moraines, or ancient glacial deposits, he noticed that day ? helped him piece together the seismic hazards underlying the Lake Tahoe region.

"As you walk along these very prominent geologic features, all of the sudden, that same feature is now over there," said James Howle, a geologist with the U.S. Geological Survey in Carnelian Bay, Calif. "These long, linear moraines are very abruptly offset, and I couldn't help but ask, 'What caused that?'"

Howle has been studying the region ever since. He's now identified five active seismic faults, which point to important landslide and earthquake hazards ? potentially up to magnitude-6.9 temblors ? for those living near Lake Tahoe.

Finding faults
Together, the five faults make up the Tahoe-Sierra Frontal Fault Zone, which lies between the Sierra Nevada and the west side of Lake Tahoe. Geologists had known about several of these faults before Howle's latest findings, which were detailed online May 18 in the journal Geological Society of America Bulletin, but heavy tree and brush cover made the area difficult to survey.

Using LiDAR, a type of laser radar that can "see" through dense vegetation, Howle's team precisely traced the five faults and measured their offsets, or the distances seismic activity had moved land on each side of the faults. They also found, from radioisotope data, that the glacial moraines in the region were 21,000 and 70,000 years old ? an important piece of the puzzle that scientists hadn't known before, Howle said.

The data allowed Howle's team to calculate how fast the land along the faults is moving. The rates they calculated are two to three times greater than had been estimated, he said. [ 13 Crazy Earthquake Facts ]

Those slip rates boil down to significant seismic risks. A rupture along any of the five faults could generate a magnitude-6.3 to 6.6 quake, the team calculated. If two or more adjacent faults ruptured together, they could produce a magnitude-6.9 or greater quake.

"The seismic hazard itself hasn't increased," Howle told OurAmazingPlanet. "The faults have always been there, the hazard has always been there, we just didn't have the data to quantify it until now."

What do the findings mean for those who call Lake Tahoe home? Be prepared, advised Howle, who lives in the area and has no plans to relocate.

The faults have not produced any major quakes since people have been living in the region, but that doesn't mean they won't, he said. The team doesn't have enough evidence to determine exactly how often earthquakes recur along these faults, but Howle estimates it's on the timescale of thousands of years. Since they don't know when the last quake occurred, the next could hit at any time.

What's more, earthquakes aren't the only danger. The team's LiDAR images show evidence of massive ancient land and rockslides associated with the quakes.

"It's kind of a latent hazard, and people don't take it seriously because there hasn't been much seismic activity here in historical times," Howle said. "But these new data clearly show the faults are active. They haven't ruptured while we've been around here, but they have been active in recent geologic time."

Old aerial photos supply new knowledge on glaciers in Greenland

The glaciers in southeast Greenland are retreating rapidly with the ongoing global climate change. But now research from the University of Copenhagen shows that the glaciers can recuperate within a short timeframe if temperatures are to drop. The results are based on a collection of Danish aerial photos combined with both old and modern satellite imagery as well as field work. The scientific results have created international attention and have been published as a cover story in the highly esteemed journal Nature Geoscience.

"We have managed to get an overview of the glacial evolution over a period of 80 years. This is the first time ever this has been done in a study of glaciers in Greenland. Results show that glaciers can recuperate within a short time frame if climate changes and temperatures drop, as it has in a period after the 1940s," says PhD student and lead-author on the project Anders Bj?rk, from Professor Eske Willerslev's Centre for GeoGenetics from University of Copenhagen.

Anders Bj?rk adds:

"Most of the scientific foundation, models, and theories on glaciers in Greenland and how global warming affects them are based on observations from satellites over the last ten years. Otherwise scientists have had to use previous warming events way into the past when wanting to compare today's massive retreat."

A fight for land between Denmark and Norway

The Danish explorer Knud Rasmussen and his seventh Thule-expedition in 1932-33 is a significant cause for the recent publication from Anders Bj?rk and Dr. Kurt H. Kj?r from the Natural History Museum of Denmark, University of Copenhagen. Results have created international attention as Greenland stands as an important region for northern latitudes are affecting the rest of the earth's climate ? including changes in glacial conditions and related sea-level rise.

Originally, the many aerial photos, which have been achieved Danish National Survey and Cadastre, were used for producing new maps of the region in the early 1930s, as Denmark and Norway were fighting over the right of disposal of East Greenland, a fight without casualties which Denmark won at the International Court in Haag in the Netherlands in 1933.

Photos get a renaissance

With help from the scientists and the Danish National Survey and Cadastre, the unique aerial photos have now gained a renaissance in a different setting where climate change and theories as "The Tipping Point" ? where nature reaches a point where changes cannot be reversed are discussed.

"We have investigated no less than 132 glaciers on a 600 km coastal stretch in Southeast Greenland, both those who terminate on land and those who calve in the ocean. The historical photos have proven to be extremely valuable, and with these photos and other aerial photos recorded later during WWII and satellite imagery we are able to observe glacier change in very long historical context. In the early 1920s and 1930s, temperatures were high, similar to that of the present, and this affected the glacial melt. At the time many glaciers underwent a melt similar or even higher than what we have seen in the last ten years. When it became colder again in the 1950s and 1960s, glaciers actually started growing," says Dr. Kurt H. Kj?r and underlines:

"There should be no doubt that if the current temperature rise in Greenland continues then we will have problems with the melting of the glaciers. We are already seeing it now on the marine terminating glaciers where changes in temperature and ocean currents are influencing their stability. Another remarkable discovery we did was that the observed changes are not just local, it is happening in the entire region," says Dr. Kj?r.

Kurt H. Kj?r has previously worked with his colleague Svend Funder from Center for GeoGenetics on investigating sea ice extent in the Arctic Ocean. Results showed that the sea ice extent has been far from stable throughout the last 10,000 years.

For-profit schools jump to enroll military spouses

MIAMI (AP) ? "Unleash the dog trainer inside you," urges an ad for the online Animal Behavior College, which makes no bones about whom it's trying to recruit. In television and online ads, it speaks directly to military spouses. The message: You may be able to attend for free.

The ads are working. In three years, 2,255 military spouses have enrolled, and the college has collected more than $2.7 million in taxpayer-funded spousal education benefits from the Pentagon ? among the most of any school in a program called the Military Spouse Career Advancement Accounts, or MyCAA.

But three years into the MyCAA program, concerns are growing that it's been caught up in a broader gold rush by for-profit colleges to recruit students with military ties and cash the taxpayer-financed tuition checks they carry with them

As the Iraq and Afghanistan wars began winding down in recent years, Congress passed a series of substantial education benefits. The best-known was the post-9/11 version of the G.I. Bill, which updated the original version that put much of the post-World War II generation through college and helped fuel the country's postwar economic prosperity.

MyCAA was a small part of that broader effort, created by the Pentagon to support military wives and husbands. The benefit was seen as long overdue, considering the strains spouses endured during the wars and their high rates of unemployment. It was also a retention tool; by giving spouses a career boost, families might have more stability to stick with a military career.

But MyCAA has become particularly worrisome. Overall, 60 percent of federal education money for military wives and husbands has gone to for-profit schools, compared to 38 percent for the G.I. Bill in the 2011 fiscal school year. Neither program requires schools to be accredited; they only need to be approved by a state agency. And the Pentagon isn't tracking how many MyCAA beneficiaries have earned a degree or found employment.

"The Department of Defense is not doing enough to really oversee this program," said Sen. Tom Harkin, D-Iowa, chairman of the Senate Health, Education, Labor and Pensions Committee, which raised concerns about MyCAA in a recent report.

Another concern: Academically, the military spouse benefit is more limiting than other military education benefits including the GI Bill. It can be used only to pursue an occupational credential or an associate's degree, not a bachelor's or graduate degree. That keeps costs down, but sends a grating message to some, especially after the program ? originally open to all military spouses ? was limited to the wives and husbands of junior service members.

"I know many spouses who are junior ranks who want to achieve something more than an associate's degree," said Bianca Strzalkowski, a Marine Corps wife named "Military Spouse of the Year" in 2011 and who has traveled around the country speaking about education issues.

Strzalkowski said there has been an outcry among spouses over both MyCAA's restrictions and its lack of oversight.

"We usually have the same exact aspirations in life as our service members," Strzalkowski said. "The same skill set. If you are going to hold them to a certain standard, hold us to the same standard and make it an effective program."

The Animal Behavior College was started in 1998 by Steve Appelbaum, who previously ran a nationwide dog training business. Students start off with online readings and written assignments, and then are assigned by the school to an externship, with either a mentor dog trainer or at a veterinary hospital in their community.

Appelbaum said the model is a natural fit for military spouses because it can be done from anywhere. The program costs about $3,000; military spouses comprise less than 25 percent of their total business, he said.

"It's still a good chunk of students but it's certainly not what the school is living on," Appelbaum said.

Prisca Crisp, 25, used MyCAA to enroll in the school's dog training and veterinary assistant programs and graduated in 2010. Since then, she's approached six different animal hospitals looking for employment but has not found a job in the field.

"I've been going online and posting my resume everywhere," Crisp said.

Twenty-five percent of military spouses are unemployed, about three times higher than for the general population, according to the Department of Defense. Most want to work, but holding a steady job is challenging. Military families move frequently, leading to short-term employment and gaps in resumes. And some career fields can be harder to continue in certain parts of the country.

Pursuing a college degree can be just as challenging. Strzalkowski herself has enrolled in five different colleges since 1999, starting at a new school each time her family was transferred, and often finding her previous credits weren't accepted.

"I have taken an intro to business course at three different schools," she said.

The MyCAA program is designed to help spouses find a "portable" career ? a job in a high growth, high demand industry with likely openings no matter where they are stationed. That can include everything from baker or cosmetologist to mechanic or librarian.

Three years in, more than 3,000 schools have been approved to receive MyCAA dollars and 147,432 spouses have enrolled in courses. Department of Defense figures indicate course persistence is quite high: Spouses successfully completed 87 percent of the courses they were enrolled in during the 2011 fiscal year. However, the Pentagon doesn't yet know how that translates into degrees and certificates awarded, or job placement rates.

"You have to assume, I guess, and maybe this is wrong, but those that are using the funds for an occupational license or credential, that's what the funds are actually used for, to obtain that license or credential," said Aggie Byer, director for military spouse education at the department. But, she said, a thorough review is under way.

Part of the reason why there isn't data on outcomes like number of degrees granted and graduation rates is that many of the programs are not overseen by the U.S. Department of Education. Because schools like Animal Behavior College do not collect Title IV financial aid from the government, they are exempt from outcome-tracking as well as other federal regulations designed to protect students.

Harkin noted military spouses have just one chance to receive the benefit, and could be left at a significant disadvantage if, for example, they later try to transfer to a two- or four-year college degree program and find their credits aren't accepted.

"This money really should be used to help these spouses to go community colleges, for example, or to get a quality online program that is approved and accredited," Harkin said.

For spouses like Ivanna Fernandez, whose husband is in the Air Force and currently deployed in Qatar, the MyCAA benefit is one of their only opportunities to get some form of higher education paid for by the military.

The 20-year-old Florida native has moved twice with her husband, working odd jobs and caring for the Cavalier King Charles Spaniel puppy her mother-in-law gave her as a wedding gift.

Last year, she went online to search for a dog trainer school. The Animal Behavior College was the first result that popped up. The school's website prominently displays information on how military spouses can apply.

"They leave a little box for you to put your number in, and someone calls you almost within the next 10 minutes," Fernandez said.

Appelbaum, ABC's founder, said the school had not applied for Title IV approval because the relatively low price means most students don't need to take out financial aid to attend. The only approval the college has received is from the California Bureau of Private Postsecondary Education, which does a review of the school's financial resources, faculty, and enrollment agreements, said Russ Heimerich, spokesman for the California Department of Consumer Affairs.

Appelbaum said the school discloses to students that neither a dog training nor a vet assistant certificate is needed to pursue a career in either field. He said a certificate nonetheless helps open doors when seeking employment.

"If you spend 100 hours working at veterinary hospitals, assuming you don't get hired at that hospital, you are going to have a much easier time getting hired than if you just walk in off the street," he said.

Crisp, whose husband has been deployed to Iraq and Afghanistan, said the hospital where she did an externship wanted to keep her on staff but wasn't hiring at the time. She was told she'd get a call back but never did.

In the meantime, she's been working as a pharmacy technician, a field in which she earned a certificate from a community college before claiming her MyCAA benefit. She is doing some dog training on her days off and still has hopes of finding full-time work in the field.

"I just don't want to give up just yet," she said.

Others have had more luck. Sarah Casey, a military wife living near Seattle, found a job at a dog training and daycare facility within two months of moving to her family's current post. She had prior experience working at dog kennels and vet clinics, but still thinks getting the certificate was helpful.

"I gained a lot of knowledge," Casey said.

Fernandez was pleased with her course at ABC, but said she was never told that a certificate wasn't necessary to pursue a dog training career.

"I wasn't aware of that," she said. But, she added: "I wouldn't be able to be a dog trainer, though, without the program."

Fernandez is putting her hopes into making dog training a sustainable career. She's currently shadowing a mentor dog trainer assigned to her by the school and later plans to volunteer at a shelter. College isn't out of the question ? but for that, she'll have to find money elsewhere.

?? With the Saints bounty case moving to grievance hearings and court, NFL owners will talk about player safety when they meet on Tuesday.

?? The issue is on the agenda for the owners' session in Atlanta, where Commissioner Roger Goodell is certain to be asked about Saints linebacker Jonathan Vilma's defamation lawsuit against him. Meanwhile, Goodell's authority for administering discipline is being challenged by the players' union, Vilma and three other players suspended for their roles in the pay-for-hits system.

?? That's the hot topic, but hardly the only topic. Owners also will discuss several bylaw changes that were tabled in March, including designating one player suffering a major injury before Week 2 of the season as eligible to return from injured reserve, and moving the trading deadline back two weeks to after Week 8.

?? Atlanta Falcons President Rich McKay, chairman of the competition committee, expects both measures to pass.
?
?? "There were good ideas and suggestions, no resistance," he said at the last meetings. "We'll work on the language."

?? The language from the players punished in the bounty case has been strong and challenging of the league's findings. Vilma's lawsuit claims Goodell made false statements that tarnished the linebacker's reputation and hindered his ability to earn a living playing football. Vilma has been suspended for the 2012 season.

?? The suit in U.S. District Court in New Orleans claims Goodell, "relied on, at best, hearsay, circumstantial evidence and lies" in making comments about Vilma while discussing the NFL's bounty investigation.

?? The union filed a grievance with an arbitrator asserting that Goodell has no power to discipline players for actions that occurred before the league's current labor agreement was signed last August.

?? Vilma and current Saints teammate defensive end Will Smith, plus former Saints Anthony Hargrove, a defensive end now with Green Bay, and Scott Fujita, a linebacker now with Cleveland, have appealed their suspensions. Smith got four games, Hargrove eight and Fujita three.

Their appeal asks another arbitrator to decide if the players should be punished for the system that the league says ran for three years and paid improper cash bonuses for hits that injured targeted opponents. The union argues that the arbitrator, Stephen Burbank, and not Goodell should hear the four players' appeals.

?? On other issues, the NFL has informally looked at further changes to kickoff returns, considered the most dangerous play in football. It already has altered the defenseless player rules to include offensive and defensive players, and there even have been suggestions about eliminating the three-point stance for line play.

?? Equipment issues also could be discussed at these meetings, with a close eye on concussions. Dozens of lawsuits have been filed against the league by former players and their families claiming the league didn't warn them about the long-term effects of head trauma.

Chocolate rabbits with red ribbon wrapping not Community trade mark protectable, ECJ rules

The ECJ said that the shape is "devoid of any distinctive character."

Confectionery company Lindt & Spr?ngli (Lindt) had tried to register the "3D sign representing the shape of a chocolate rabbit with a red ribbon" as a Community trade mark in 2004, but its application was rejected. The Office for Harmonisation in the Internal Market refused the request on the basis that it was a shape devoid of any distinctive character, and in 2010 that finding was upheld on appeal to the EU's General Court.

Lindt's appeal to the ECJ, the EU's highest court, has now also been rejected on the same grounds.

"The distinctiveness of the mark must be assessed, first, by reference to the goods or services for which registration is sought and, secondly, by reference to the perception of the relevant public," a statement by the ECJ said. "In that regard, the Court rules that the General Court correctly identified and applied those criteria by carrying out an evaluation both of current practices in the industry and the perception of the average consumer."

"As regards the acquisition of distinctive character through use of the mark applied for, the Court confirms the reasoning of the General Court which found that Lindt had not proved that distinctive character had been acquired through use across the EU," it said.

Trade marks allow companies to stop rivals using certain features of products or logos to protect their ability to identify products as coming from that company rather than another company.

The ECJ confirmed the General Court's view that it could not offer trade mark protection for Lindt's product as a whole because it consisted of elements which were not unique to it. The General Court had said that many chocolate makers create bunnies, reindeer and other animals and often wrap them in foil and adorn them with ribbons.

Lindt has been in trade mark dispute over its chocolate bunnies in the past. It began selling them in Austria in 1994 and in 2000 registered the whole foil-covered bunny as a trade mark there.

Austrian chocolate maker Franz Hauswirth had been selling bunnies there since the 1960s and the ECJ was previously asked if by registering a trade mark for a product that had been sold for many decades in that market, Lindt had automatically acted in 'bad faith', which would in turn invalidate the trade mark.

The ECJ said that it could not precisely define bad faith and that it was up to national courts with the facts at their disposal to rule in particular cases whether there had been a registration in bad faith or not.

Under the EU's Trade Mark Directive and Community Trade Mark Regulations, trade mark owners can prevent competitors from "using in the course of trade any sign which is identical with the trade mark in relation to goods or services which are identical with those for which the trade mark is registered" without their consent.

The Directive also permits EU member states to draw up national laws giving extra protection to trade mark owners who possess a reputation in that country if others' use of similar or identical signs for similar or identical purposes "without due cause takes unfair advantage of, or is detrimental to, the distinctive character or the repute of the trade mark".

In the UK, trade mark protection can be obtained by registering signs with the Trade Marks Registry at the UK's Intellectual Property Office. Under the Trade Marks Act "any sign capable of being represented graphically which is capable of distinguishing goods or services of one undertaking from those of other undertakings" can be registered subject to certain conditions. The Act states that marks cannot be registered if they are "devoid of any distinctive character" or if an application is made in "bad faith".

In the UK mark owners may also obtain 'goodwill' rights to unregistered marks giving them legal protection under the laws of 'passing off'. If mark owners can prove that their use of a trade mark has established 'goodwill' in the business associated with that trade mark protection to that mark may apply. Goodwill relating to a trade mark is essentially the benefit or value a business owner receives from using that mark. If another trader 'passes off' their services as being those of mark owners and appear to claim that their services are theirs or that they are in some way connected or have been endorsed, then mark owners can take action.

Record Number of California School Districts Near Bankruptcy

Michelle Klampe writing in the Press Enterprise reports that many schools in California are in extreme financial jeopardy with up to 20% of school districts in the State currently looking unable to pay their bills within the next two years. She notes that districts with a qualified budget could become insolvent in as little as two years absent drastic further cuts or addition of income streams.

Twelve districts ? none in the Inland Empire ? have indicated they cannot meet their financial obligations this fiscal year or next, a budget status known as negative certification. Another 176 districts indicated they may not be able to pay their bills this year or in 2012-13 or 2013-14, a qualified certification.

Stan Scheer is superintendent of Murrieta Valley Unified School District and claims that a major challenge for schools is predicting future budgets while noting that districts weren?t allowed to make assumptions about any future employee concessions.

Murrieta Valley has furlough agreements for 2012-13 to help balance the $145 million budget, but negotiating similar agreements now for future years would be nearly impossible, he said.

?There?s no way I would even think about doing that right now,? Scheer said. ?It?s too volatile.?

This sentiment was echoed by Paul Jessup, the deputy superintendent for Riverside County office of education, who said that districts achieving a firm financial footing would be impossible while the state budget crisis continued along with uncertainty over taxation plans to provide funding for schools.

Since the 1990s, districts have been required to file financial reports a year by the 15th or December and March. These reports, known as interim reports, look at cash flow, reserves, deficit spending, labor agreements, enrollment, etc, in a complete review of fiscal health for the current year and anticipated fiscal health for the two following years.

School districts which get qualified or negative certification face extra oversight from the county office and have to file a third interim report. The additional county oversight effectively means that the district?s spending decisions will be reviewed and can be vetoed.

The number of districts and other local education agencies facing bankruptcy has increased by 61 since February and by 45 over the previous year?s list.

The lender notifies the borrower and any other affected parties in person (or in some cases by mail or publication). If the borrower does not respond to the court action within a specified amount of time, the county clerk can find the borrower in default and the lender can ask the court to make a final ruling. If the court rules against the borrower, the ruling will include the total amount owed to the lender (final summary judgment) and the foreclosure sale date.

Condo & HOA Law: The Lien and Foreclosure Process in Florida

The association is required to give notice to the homeowner prior to filing the lien by sending two copies of the notice, one by regular mail and one by certified mail, that includes the amount due and the deadline for payment. For HOAs this is 45 days and for condos this is 30 days. If you missed payments, the lien will include the assessments, interest, attorneys fees, and if the governing documents allow, late fees. Once you are turned over to an attorney for collections any payments are applied to all the fees first and assessments last.? After the lien is recorded the association must then go through the same process to foreclose before filing to foreclose on your home. Once you receive a summons, you have 20 days to file an answer and affirmative defenses or a motion to dismiss. The association will file a motion for summary judgment, which means there are no disputed facts and the association should get your home without a trial.? DO NOT ATTEMPT TO HANDLE THIS WITHOUT AN ATTORNEY.?Your best option is to negotiate a payment plan or file Chapter 13 bankruptcy to put this in a 5-year payment plan. Chapter 7 will not save the home.? If you missed any payments, fighting over the amount with the association is useless in almost all instances because it will generate attorneys fees that you are liable for and must be paid to keep your home. The courts will award the attorneys 100% of their attorneys fees if you are at fault, even if it?s a small amount and their numbers are wrong.? The courts are facing having their funding cut thanks to the foreclosure cases clogging up the dockets. In many cases good case law is being ignored to move the cases out of the courts and owners are being denied justice and due process because of budget concerns. This has changed the owners slim chance to virtually no chance, but that?s my personal opinion.

TALLAHASSEE, Fla. ? May 10, 2012 ? The greater Miami area led the nation in the percentage of homeowners that went through a foreclosure or who were more than 90 days behind on their mortgage payment, according to a national review of 366 metropolitan areas released yesterday by Foreclosure-Response.org, a Washington-based advocacy group maintained by the Center for Housing Policy, the Local Initiatives Support Corporation and the Urban Institute. Florida has been slow to get back on its feet because of a foreclosure process that, on average, takes more than two years to complete, according to the report. Miami-Dade/Fort Lauderdale/Pompano Beach had the nation?s highest foreclosure rate and the highest percentage of delinquent loans in December. The Miami metropolitan area had a foreclosure rate of 18.9 percent. Add to that the percentage of mortgages more than 90 days late and the figure jumps to 23.6 percent ? nearly one in four mortgages. Florida cities captured nine out of the top 10 slots on both foreclosures and delinquencies for the month. Looking at just foreclosures, Florida held the top five spots, with Miami followed by Port St. Lucie (16.7 percent), Palm Coast (16.6 percent), Tampa (15.9 percent) and Orlando (15.6 percent.) ?The high and growing foreclosure rate reflects a buildup of homes that are stalled in the foreclosure process,? the report stated. ?According to data from LPS Applied Analytics, foreclosure starts continue to outpace foreclosure sales, and the foreclosure rate will remain high until these properties fully complete the foreclosure process.? Lenders who halted foreclosure proceedings amid the robo-signing investigations are now resuming their efforts to get rid of troubled properties. Like other large cities, Florida?s metropolitan areas have seen a steady uptick in foreclosures over the past few years. Another major factor contributing to the backlog in Florida is that a judge must be involved in foreclosure proceedings, a requirement that has slowed the foreclosure process in Florida and other states that require judicial review. In Florida, the average foreclosure takes more than 800 days to complete. Recent attempts to remove judges from the equation have not garnered the legislative support needed to pass. ?This year Florida re-hired retired judges to help sort through the backlog of foreclosures,? the group concluded. ?However, the future still remains unclear in Florida and other judicial states.?

Key Case in Florida Supreme Court Could Strike a Blow Against Bank?s Fraudulent Foreclosure Practices

The Florida Supreme Court heard oral arguments in an important case that could have wide-ranging implications for foreclosures in that state. The case, Roman Pino v. Bank of New York Mellon, could invalidate the ability of banks to refile documents in situations where the initial documents they filed to foreclose on homeowners were fraudulent. Pino went through a foreclosure on his house in 2008, but attorneys found that the mortgage assignment used in the foreclosure proceedings was signed by known robo-signer Cheryl Samons and stamped with a notarization that was out of date. In depositions, Samons and colleagues at the David J. Stern foreclosure mill where she worked admitted to not just robo-signing but forgery, backdating of documents, inflated billings and a host of other illegal activities.
